General terms and conditions

  1. DEFINITION: With "CAMid", below is meant the CAMid corporation and with "customer" there is meant the buyer. Software, hardware or services are referred to the below mentioned object of agreement.
  2. OBJECT OF AGREEMENT: By signing the order, the customer acknowledges expressly to know and to accept the in the order and in the software license agreement cited terms and conditions as well as the following ones. Nature and extent of the services and/or supplies will be determined in the respective order. The installation, configuration and training as well as additional required services, which are not listed in this offer and will be subsequently required, will be invoiced after expense.
  3. DATE OF DELIVERY: The delivery date is not regarded as essential and is not binding on CAMid, other than a separate written agreement between the parts was reached.
  4. CONDITIONS OF PAYMENT: The conditions of payment are agreed between the two parts. If there is a default of payment then there is invoiced defaulted interest in accordance with statutory decree no. 231/2002. A simple delay sets the customer into default, without requiring any communication.
  5. HOURLY RATE FOR SERVICES:
    • training and program support (on demand) euro/h
    • software / program development (on demand) euro/h
    • organizatioin and system consulting, analysis (on demand) euro/h
    • telephone support and remote maintenance (on demand) euro/h
    For each local operation only the effective time at the customer in 15-minutes units is calculated, inclusive the operation flat of the respective zone. The service for telephone support and remote maintenance is calculated in 5-minutes units. As a calculation unit is defined the respective started time unit. 
    • travel costs are (on demand) euro/Km; journey there and return are calculated; minimum travel costs: flat charge (on demand) euro
    • travel costs per hour (on demand) euro per person
    • for operations outside of our usual working hours, we calculate following surcharges:
      • on working days from 5pm + 30%
      • on weekends inclusive saturday or a holiday + 50%.
    To all the given prices there has to be added the statutory VAT..
  6. RESCISSION OF THE CONTRACT: In the event of a default, which by the signing of the contract and/or this general sales conditions assumed obligations on the part of the customers, CAMid has the right to terminate the contract by interrupting the supply of the ordered goods or the execution of the service and by requiring the payment of the outstanding amount, plus the replacement of the damage suffered (loss incurred) and the recognition of the damage resulting profit shortfall. The customer can not withdraw from the contract, other than the power to do so is not expressly granted by CAMid in writing. The sale is understood to be carried out in the premises of the contractor and without prejudice to the provisions of article 1469 to the Civil Code and seq, relating exclusively to the protection of private consumer, there is no deadline for exercising the right of withdrawal granted.
  7. ACTIVATED GUARANTEE: For the warranty terms we refer to the software license agreement, which will be signed seperately.
  8. DISCLAIMER: In each case CAMid doesn't take any responsibility for direct or indirect damage caused by defects or the use of the sold product, other than there is a case of negligance or intent.
  9. PRIVACY (D.lgs 196/2003): The personal data will be stored and electronically processed for purposes of administration and to fulfill legal and contractual requirements. The data may be used by CAMid for the transmission of information within the business. The customer gives his consent, in accordance with act no. 196/2003, for editing, processing and further distribution of data in the restrictions provided by law and in any case only to the necessary extent.
  10. ARBITRAL COURT: Every resulting dispute between the parts concerning the interpretation, application and/or execution of this contract will be, according to the arbitration rules of arbitration of the commerce, industry, craft and agriculture of Bolzano, passed to the tribunal itself to become final, which consists of an arbitration panel, consisting three arbitrators will be made in accordance with the arbitration rules of the same. For the appointment of the arbitration panel, the parts refer explicitly to article 26 et seq of the said rules. In the case of a lack of use of the arbitration, it shall continue to the jurisdiction of the court of Bolzano.
  11. REMITTAL: Everything that is not expressly governed by the given general conditions, is applicable to the standards of the civil code and the relevant special laws.

Unforeseen techncal and substantive changes by the producers as well as errors expected.
